Our latest podcast episode sees Partner and head of the Personal Injury team, Victoria Smithyman, team up with Afonwy Howell-Pryce, an associate in our Wills and Probate department to discuss all things Personal Injury Trusts.
The pair break down some of the legal concepts behind a Personal Injury trust, including the benefits, the importance of 'trustworthy trustees' and the protection offered to vulnerable individuals. They also consider the practicalities of implementing a trust, including the 52-week grace period and the importance of consulting a solicitor early on in the process.
The duo then consider the link to a Lasting Power of Attorney - or LPAs - and the safety net they offer against many of life's uncertainties. Afonwy debunks some of the myths and confusion surrounding LPAs - from defining mental capacity to retaining 'control', before reflecting on the importance of openness and honesty in planning for the future.
